Request to Abandon the Litigation
An electronic service that enables the beneficiary (the plaintiff) to waive their lawsuit pending before the court.
- Access the link
- Log in to the Najiz portal with the National Single Sign-On (Nafath) account
- Select all electronic services
- Select the (Judiciary) package
- Access the (Request to Abandon the Litigation) service
- Click the (Submit new request) icon
- Select the case in which the litigation is to be abandoned
- Select (Requests)
- Add (New request)
- Select (Request to Abandon the Litigation)
- Enter the request data
- Click the (Submit request) icon
- The beneficiary is notified by text message with the request number
- Waiver in favor of one or more defendants
- The plaintiff or their agent is entitled to submit the request
- Submission of the request before the day of the session
- No more than one request may be submitted per case
- Factors affecting the acceptance of the reques
- If there is no first defense memorandum, the request is accepted automatically in this case
- If there is a first defense memorandum, the defendant has the right to:
- Accept the request, in which case the case is closed and its status becomes "ended by waiver"
- No response: if the session begins and no response is made to the request, in this case it is accepted automaticall
- Reject the request: the case continues its normal cours
- In the case of multiple defendants, where the request is accepted by some and rejected by others, in this case the case continues its normal course with respect to the parties who rejected the request
